New rules for e-commerce and apps

Europe is busy. Not only will the rules on advertising change, there will also be new rules on the provision of digital content. Other European directives in the field of consumer protection are being revised. Important news for all companies that sell via the internet or offer apps to consumers. What are the practical consequences for businesses? Some of the changes:

  • Completely new is the Digital Content Directive (2019/771). This provides rules for the delivery of digital content (such as apps). Not only paid content is covered by the new rules, but also, for example, free apps that use consumers' personal data. Among other things, it is important that the consumer has the right to receive the latest version of an app and to receive updates.

  • For webshops, it is important that in future price offers will always have to include the old price from before the offer. For example, "Now only EUR 19.95 (was EUR 23.95)". The old price must have applied at least 30 days prior to the offer.

  • The personalisation of prices is also subject to rules. Price personalization is allowed, but webshops must clearly inform their customers when this happens. This rule only applies to price adjustments based on the consumer's profile and not to the use of flexible prices that depend on current market demand.
