Nieuwe gedragscode promotionele kansspelen
De Staatssecretaris van Veiligheid en Justitie is van plan om de Gedragscode Promotionele Kansspelen aan te scherpen. De nieuwe gedragscode zal 1 oktober van dit jaar al ingaan, zo is de planning. Vooralsnog zonder overgangsregeling!
De belangrijkste wijzigingen ten opzichte van de oude gedragscode:
Alle uitgeloofde prijzen moeten daadwerkelijk worden uitgekeerd (dat betekent dus geen sweepstakes meer zonder winnaar).
De Kansspelautoriteit krijgt een verdergaand recht tot inzage (onder meer m.b.t. de opbouw van communicatiekosten en m.b.t. onpartijdige wijze van aanwijzen van winnaars).
De klachtenregeling wordt gewijzigd. De klager moet straks eerst bij de organisatie zelf zijn klacht indienen.
De maximale communicatiekosten voor het groot promotioneel kansspel en klein promotioneel kansspel gaan naar beneden van €0,60 naar €0,45.
Belanghebbenden kunnen tot 1 september a.s. hun zienswijzen indienen bij de Staatssecretaris. Op dit moment is de nieuwe gedragscode nog in de conceptfase, maar dat er binnenkort een nieuwe code komt, staat vast. We blijven de ontwikkelingen met interesse volgen.

New Code of Conduct for Promotional Games of Chance
The State Secretary for Security and Justice intends to tighten the Code of Conduct for Promotional Games of Chance (Code of Conduct). As it stands the new Code of Conduct will come into effect on 1 October 2013. For the time being without a transitional regime!
The most important changes in the concept Code of Conduct are:
All offered prizes must be paid (no more sweepstakes without a winner).
The Game of Chance Authority’s right of inspection becomes broader (for instance regarding the accrual of communication costs and the impartial appointment of winners).
The complaints procedure will change. Complainants must file their complaint with the organizer itself first.
The communication costs for a large Game of Chance are reduced from €0,60 to €0,45 cents. Furthermore, it will no longer be allowed to charge any costs for communication while participating in a small Game of Chance.
Interested parties have until 1 September to submit their points of view to the State Secretary. The new Code of Conduct is still in the concept phase at this point in time; however it is clear that a new version will come into force soon. Of course, we will monitor any developments in the matter closely.
