Johma Scharrelei salade: What's in a name?

[:nl]De naam scharrelei salade is een juiste naam voor een maaltijdsalade met als hoofdingrediënt scharreleieren. Stichting Wakker Dier vond de naamgeving misleidend omdat voor de saus van de salade ‘gewone’ eidooier is gebruikt, afkomstig van eieren van kooi-kippen. De Reclame Code Commissie heeft in een goed gemotiveerde uitspraak aangegeven dat de naam is toegestaan. Warenwettelijk mag het product zo heten (het bevat op het totaal aan ingrediënten 67 % scharreleieren). Ook is geen sprake van misleiding: de consument kan op het etiket lezen wat de ingrediënten zijn. Dus ook dat er eidooier in zit (en niet scharrel-eidooier). Dit ingrediënt voor de saus is bovendien maar 2% van het totaal. Wakker Dier heeft geen hoger beroep ingesteld, waarmee de uitspraak nu definitief is geworden. According to the Foodlaw it is licit that this product is named as such (it contains 67 % free-range eggs on the total of ingredients). There is also no question about misleading the consumer; any consumer can read about the ingredients on the label. Hence it contains egg yolk (not free-range egg yolk). Moreover, this ingredient for the sauce adds only 2 % tot the total of the product. 'Wakker Dier' did not file an appeal, thereby making the decision final. This case was pleaded for Johma by Ebba Hoogenraad, advertising law specialist in the Netherlands.[:]
